  1. This story is a wild ride. He kills someone in Albania and pretends to be Kosovan to falsely claim asylum, is allowed to stay because it would “unduly harsh” on his family, 2 of which are serving prison sentences for drug offences.

    – Has lived in the country for 24 years.
    – Would be imprisoned without trial if returned to Albania. 

    I’m actually OK with the legal system taking account of those factors in considering if someone should be deported. 

    I am rather less OK with the likes of Jenrick railing against the right to a fair trial under Article 6 ECHR.

    France is prepared to break European human rights law to expel “dangerous” foreigners as President Macron’s government pledges the toughest crackdown on immigration in 30 years.

    Gérald Darmanin, the interior minister, said France would deport foreigners deemed a threat without waiting for the European Court of Human Rights (ECHR) to hear their appeals. If their removal was judged to have violated the European Convention on Human Rights, Paris would pay a fine but not allow them back.

    This is out to float the posts ahead of a possible Jenrick trying to win Con leadership. Leaving ECHR is like his flagship thing

    There will be an ‘X happened because of ECHR’ headline in every edition of the Telegraph and Mail for the next few months. ‘I shat myself because of ECHR’ will be the shocking conclusion.

  8. There are so many hit pieces out for the ECHR right now. Especially from tory papers like the telegraph. Especially on this sub. There is a concerted and coordinated effort to smear the ECHR and we are watching it live. WTF.

    Albania sought to extradite him as he was convicted of murder in Albania in 1998. 

    From the article: ‘Judges rejected an extradition request by Albania on the basis that he was never arrested and that there was “no material to show that he knew, or should have known, of the date and place of his trial and that the trial might proceed in his absence”. They also accepted that there was not “sufficient assurance” that Bleta would receive a re-trial or a review amounting to a re-trial, which meant there was a “real risk” that returning him to Albania would be a “flagrant” breach of his article 6 ECHR rights to a fair trial.’

    I have serious concerns about this guy, but I don’t disagree with this decision. We can’t ignore the right to a fair trial and send him to serve a life sentence in Albania.  The point about these rights is that they are absolute, otherwise what do we do when Russia decide that a random anti-Putin campaigner conveniently murdered someone before they fled the country. 

  10. I can’t help but dismiss The Telegraph as a source of information. Wasn’t it once regarded as a decent, if known right wing biased, newspaper? What happened?

  11. Interesting to see so many “ECHR is flawed articles” flood in the past week or two despite years of silence.

    Once again the media is proving it’s an arm for the rich to control the masses.
