This is important news because it is the first time that a publishing group is recognized for the fact that Microsoft “exploits” content written by others to make them appear in the search (news), even if the amount is laughable. However, this means that it is possible/probable that the next one will be Google (and I think that the figures will be much higher given the revenues and the market that Google VS Bing has).

This is the first measure of this type adopted by the Authority, in application of the regulation it adopted in January 2023. It is ‘the first measure involving an information society service provider (Microsoft) other than media monitoring and press review companies’, the note explains.

The fair compensation due to publishers, as established by the Agcom regulation at the beginning of the year, was decided by Agcom by applying various criteria such as, for example, the advertising revenues recorded by the provider deriving from the online use of the publisher’s journalistic publications, net of the publisher’s revenues attributable to the redirect traffic generated on its website by the journalistic publications used online by the provider.

From another item:

With this decision the Authority also expressed its opinion on the definition of ‘very short extract’, interpreting the qualitative criterion dictated by the legislator in light of the change that has characterized the supply and demand of information in the new social context.
