The resident of Ganja will also receive compensation
On October 10, the European Court announced 3 decisions and rulings regarding Azerbaijan.
The court case “Aygul Jafarova and others v. Azerbaijan” is related to the complaint of a group of social activists.
This case concerned alleged violations of the right to assembly and to have an effective remedy. The government acknowledged the violations in a unilateral declaration during the communication and undertook to pay compensation to the applicants. According to the court decision, each of the applicants – Aygul Jafarova, Gulnara Mehdiyeva, Vafa Naghi and Seymur Nazarova – should be paid 1575 euros.
The complaint of Eldar Hasanov, who was the former chief prosecutor and ambassador of Azerbaijan, against Azerbaijan was also considered. The applicant was represented by lawyers Emin Abbasov and Emin Aslanov, lawyer Javad Javadov.
Eldar Hasanov, who is currently serving a sentence in prison, was arrested for the crimes of abuse of power, use of state funds for other purposes than intended, money laundering, embezzlement and forgery committed at the Embassy of Azerbaijan in Serbia. The complaint is about his pre-trial detention. The applicant’s complaint was based on Articles 3 (prohibition of inhuman or degrading treatment), 5 (unlawful interference with the right to liberty and security) and 18 (restriction of restraints) of the Convention. The applicant claimed that there were no reasonable grounds for his detention and detention, and that he was not provided with the necessary medical assistance while in custody. Based on Article 34 of the Convention, the applicant also complained that the Azerbaijani government violated his right to individual appeal by not complying with the Court’s decision to take provisional measures under Rule 39.
In this case, the Court ruled that Articles 3 (between August 13, 2020 and July 2, 2021) and Article 5 (right to liberty and security) of the Convention were violated in relation to the applicant. According to the decision, the government must pay the applicant 9,234 euros in moral damages and costs.
In the “Aynur Bagirova v. Azerbaijan” case, the applicant, 48-year-old Aynur Bagirova, is a resident of Ganja. His brother was killed in July 2018. At that time, his brother was wanted and was killed during an operation conducted by law enforcement agencies.
The applicant claimed that his brother was killed intentionally and that the local authorities did not conduct an effective investigation into the death.
The lawyer of the applicant is Javad Javadov.
The Court recognized the alleged violations in this case and found a violation (both procedural and substantive) of Article 2 (right to life) of the Convention. The government must pay the applicant 32,000 euros in moral and financial compensation.
