    Would this be considered ‘Deceptive Marketing’?

    So tonight I went to place an order though the app for our local Guzman y Gomez in Hawthorn – after seeing this promo earlier today on SM. As you can see from the screenshots, for the delivered option – the meal cost has been increased (whilst smugly showing the delivery fee as $0). Same order, same location – one is pick up and the other delivered. Looks like the ‘free delivery’ is actually being added to the food cost and charged at $13.60?

    Consumer Affairs VIC website says: ‘It is unlawful to make false or misleading representations about products and services when supplying, offering to supply or promoting those products or services. For instance, a business must not make false or misleading representations about: the standard, quality, value or grade of products or services.’

    So is this not a bit of scammy deceptive marketing, on the part of GYG?

      Definitely shady, but I bet their T&C’s has a clause stating that they can price their items differently for pickup versus delivery.

      Wonder if that same item is usually more expensive for delivery, even when there’s no “free delivery” option?

      Yes. Accusing this of being Mexican food is indeed deceptive.

      I’ve seen the increases on delivery apps, which is fair as uber etc charge the restaurant a shit ton, but never their own app. Pretty dodgy.

      i tried to use this deal the other week, spent $90 for my food to be delivered cold. tried getting a refund, as they deliver through uber got told to contact them, uber tells me to contact gyg i email gyg as of today (saturday) my order was 8 days ago, i’ve had ONE email back as they have no customer service staff on weekends and that email was to say that they offer support through uber through the app with no moves to help me get my money back or offer any actual support. i’m so mad, i think i’ll be doing a bank charge back
