> Counsel for Mr Kashif, Constantine McMahon BL, claimed the dismissal was disproportionate and unreasonable and had caused reputational damage to her client as well as financial loss.
What reputation? He’s a sex offender
> While there was no doubt that Mr Kashif’s conviction presented Aldi with a “monumental management challenge,” she said Aldi had no regard for his unblemished work record and uneventful service over eight weeks following his conviction.
8 weeks, are we to be impressed? Most people can behave themselves for that long.
> It ordered Aldi to pay the complainant compensation of €5,000 representing two months’ salary.
5K and whatever the legal costs are is not a tonne for a business like Aldi, but it shouldn’t happen. At least they get the moral victory; they are now painted in the papers as a company that takes staff and customer safety seriously.
The great shame of this country since the formation of the Republic is it’s blasé attitude towards sexual abuse, and it still exists.
Aldi screwed up the process, is the nub of the matter. The WRC won’t allow an employee to be hung without a fair trial, and most successful cases against an employer involve an element of procedural error.
In this case you might not like the guy benefitting, but as an employee you are protected by the same system.
What happens if Aldi simply refuse to pay him a penny ? What’s the end of the line as far as what can, and is likely, to happen if they would proceed this way ?
[Limerick sex assault victim endured three and a half hour attack (limerickpost.ie)](https://www.limerickpost.ie/2022/12/21/limerick-sex-assault-victim-endured-three-and-a-half-hour-attack/)
Interesting question: can you fire an employee for something they did before you hired them and that took place nowhere near your premises?
Sex offenders aside (you could argue that children enter the store and therefore it would be inapproriate to keep the employee) but it sets an awkward precident for people convicted of non-sexual crimes.
This is one of the many many reasons that I outsource to contractors rather than hiring direct employees. It’s just not worth the hassle.
Alternative headline – Aldi forced to pay €5k to sex offender former employee because the justice system refuses to keep women safe.
The legal profession are, as a whole, absolutely bottom feeding vermin. Nothing will convince me otherwise.
Wicklow county council can’t sack a pedaphile because of the same reasons. He sits at home getting paid. Convicted and all. Used to be the Clark of works.
The Workplace relations commission must massively add to costs of doing business here. Abolish it!
5 grand to get rid of a convicted sex pest. Bargain.
He can’t be placed on the sex offender register because his sentence was suspended. Wtf is all that about?!
Surely the co-worker he attacked could bring Aldi to the WRC because he wasn’t fired once convicted???
The Irish justice system really hates women. A horrible indictment of the country.
wft
hope he gets sued by the victim
Aldi were 100% correct to dismiss him. Awful decision from the WRC imo
Why wasn’t this man deported?
