I received this letter today from the city of Zurich, stating that I have to pay a 90 CHF fine due to my bicycle accident. Last October, I had an accident on the Uetliberg Trail where I slipped and broke my leg.
They claim that I didn’t have control over my bike, which led to the accident. However, I actually slipped because of the wet surface, which could happen to anyone.
Is this fine normal? Has anyone else experienced something similar?

It seems idiotic to complain about a Mountainbike accident on a trail lmao, you can lose control at anytime due to different factors (wetness of the ground for example)….
Just a fee for the criminal procedure, not a fine. The case has been closed w/o conviction due to your personal hardship (Speedy recovery btw.).

That’s the definition of not having the control over your vehicle. Looks like you were going too fast for road * and weather condition. [Art. 31 Abs. 1 SVG](https://www.fedlex.admin.ch/eli/cc/1959/679_705_685/de#art_31) is the catch me all clause in case of an accident.

Thats normal. You dont get a fine for violating the traffic laws due to your injuries but have to pay the process fee.
You are lucky it’s only 90 and everything you do against it will only make it more expensive. Oh and lawyer will be around 200/hr.
Classic case of “Nichtbeherrschen des Fahrzeugs”.

Well to be honest, you didnt control your bike as you felt and goibg too fast is likely a contributing factor to the accident. Unsure if that justifies the money though

I crashed and broke my collarbone also entirely on my own and the police informed me they would not initiate a Verfahren. I guess in your case they did but the judge said throw it out but you pay the costs.
So actually, this CHF 90 does not appear to be a fine, it appears to be the fee for the judge to have a look and throw out the case.
Of course, the handling of the vehicle also includes taking into account the conditions (e.g. wet road).
It is unclear to me why an investigation was initiated at all. Did you initiate it?

Welcome to Switzerland. Every crash with any vehicle is „nichtbeherrschen des Fahrzeugs“ even if you do a wheelie or burnout
“lucky” u broke ur leg and are already punished enough in their terms.
otherwise u would have gotten an actual fine, cause ur not alone on the streets and could have hurt someone else.
if u slip with ur bike because of wet surface that just means u were driving to fast for the actualy weather condition.
It’s a typical swiss thing. Whenever there is an accident, they try to punish you with “nichtbeherrschen des fahrzeugs”. That’s why it’s always recommended to not call the cops if possible or if it is not absolutely necessary.
Do you know why the police even heard of this? Did an ambulance pick you up? I crashed there last year but made it to the doctor on my own and never heard from the police.
