Students of a school in Syunik had suspicions that their fizkult teacher, who happened to be the mayor of the community, was raping one of their peers, a 14-year-old girl with developmental disabilities.

The students began to monitor the teacher for 2 months and attempted to help the victim. One of the students witnessed a sexual assault act through a keyhole and alerted it to two other teachers, who refused to act.

The news eventually reached the victim’s parents, who called the police. The teacher was charged with rape. The investigators found that he raped her in the municipality building, too, and sexually assaulted other students. One of the students became pregnant.

The teacher was sentenced to 8 years in prison. The Appeals and Cassations courts upheld the verdict.

The parents sued the state for ֏60 million for non-material damages. The Lower court refused to hear the case, while the Appeals court also denied it and ruled that the Armenian law did not envisage compensation for non-material damage. To make things worse, the Appeals court published the child’s personal information on its website.

The ECHR also found that the State did not take sufficient measures to protect students, especially those with disabilities, from sexual crimes. Not enough was done to discover, prevent, and investigate such cases. The child’s information was not protected.

The ECHR orders Armenia to pay €32,000 to the victim.

The rapist died years ago.
